अपराधियों को वोट मत दो, सरकार वोट कानून को बदले

अपराधियों के राजनीति में प्रवेश ने मतदाता के सामने, 'किसे वोट दें?', यह एक समस्या खड़ी कर दी है. अक्सर ऐसा होता है कि सभी उम्मीदवार किसी न किसी अपराध में शामिल होते हैं. मतदाता अपने मताधिकार का प्रयोग करना चाहता है पर इन्हें अपना प्रतिनिधि  भी नहीं चुनना चाहता. मतदाता के सामने यह एक ऐसी मजबूरी है जिसका कोई समाधान नजर नहीं आता. 

वोट कानून के सेक्शन ४९(ओ) के अंतर्गत मतदाता यह निर्णय कर सकता है कि उसे किसी भी उम्मीदवार को मत नहीं देना, पर ऐसा करने पर उसका नाम गोपनीय नहीं रहता. उसे चुनाव अधिकारी को अपना यह निर्णय बताना पड़ता है और एक फार्म भी भरना पड़ता है जिसमें उसका नाम भरा जाता है और उस पर हस्ताक्षर भी करने होते हैं. चुनाव कानून ऐसे मतदाता के साथ भेद-भाव करता है. किसी को भी वोट न देने की प्रक्रिया को जटिल बना दिया गया है और उसमें गोपनीयता भी नहीं है. जबकि किसी उम्मीदवार को वोट देने वाले मतदाता का नाम गोपनीय रहता है. 

एक एनजीओ (पीयूसीएल)  ने इस भेद-भावः के ख़िलाफ़ अदालत में याचिका दे रखी है. एनजीओ का कहना है कि इस भेद-भावः को दूर करने के लिए कानून में बदलाव लाया जाय. इसके लिए वोटिंग मशीन में एक बटन 'वोट नहीं देना' के लिए लगाया जा सकता है. मामला वर्ष २००४ से अदालत के विचाराधीन है. सरकार का पक्ष इस बारे में नकारात्मक है. उस ने अदालत में इस भेद-भाव को उचित ठहराया है. 

मतदाताओं को अपने इस अधिकार की गोपनीयता सुरक्षित करने के लिए एक जुट होना चाहिए. जिस रफ़्तार से चुनाव में अपराधियों की संख्या बढती जा रही है, मतदाताओं को अपनी हित के लिए संघर्ष करना होगा. इस विषय पर आज के अखबार में एक ख़बर छपी है. उसे पढने के लिए आप इस्केंड फोटो पर क्लिक कर सकते हैं.

लोक सभा चुनाव और प्रतिवद्धता शपथ

प्रजातंत्र में चुनाव एक ऐसी प्रक्रिया है जिस के माध्यम से जनता अपने प्रतिनिधि चुनती है. जनता का प्रतिनिधित्व करने के इच्छुक व्यक्ति अपने नाम का प्रस्ताव करते हैं. इसके लिए चुनाव आयोग के सामने वह नामांकन भरते हैं. अगर एक ही प्रस्तावक है तब उसे प्रतिनधि घोषित कर दिया जाता है. अगर एक से ज्यादा प्रस्तावक हैं तो मतदान का सहारा लिया जाता है और सबसे अधिक मत पाने वाले प्रस्तावक को निर्वाचित घोषित कर दिया जाता है. यह प्रतिनिधि पाँच वर्षों तक जनता का प्रतिनिधित्व करता है.  

यह असंतोष का विषय है कि आज कल कोई भी व्यक्ति, बिना सोचे समझे और विचार किए, अपना नामांकन दाखिल कर देता है. किसी प्रकार की कोई प्रतिवद्धता नजर नहीं आती. चुनाव को लोग एक व्यवसाय के रूप में देखते हैं. पिछले विधान सभा चुनावों में, एक राजनितिक दल की एक वरिष्ट सदस्य ने यह आरोप लगाया था कि दल का नामांकन देने के लिए इच्छुक व्यक्तियों से पैसे लिए गए. उस दल ने इस सदस्य को दण्डित कर दिया पर उस के आरोपों कि जांच नहीं की. 

लोक सभा चुनावों में हर प्रस्तावक को एक प्रतिवद्धता शपथ लेनी चाहिए और उसपर हस्ताक्षर करके उसे जनता के सामने प्रकाशित करना चाहिए. एक ऐसा शपथ पत्र नीचे दिया गया है. राजनीतिक दलों  को अपने प्रस्तावकों से यह शपथ पत्र हस्ताक्षरित करवाना चाहिए, और जिस प्रस्तावक को दल नामांकित करे उसका शपथ पत्र जनता में प्रचारित करना चाहिए. निर्दलीय सदस्य भी यह शपथ पत्र जारी करें. 

STATEMENT OF COMMITMENT

I, (name of candidate), make following statement of commitment:

That I have offered myself to represent the people of (name of constituency) in Lok Sabha as an official candidate of (name of party), or as an independent candidate.
That I stand committed to the ‘Politics of Service’ and not ‘Politics of Power’.
That I believe that in parliamentary democracy people elect their representatives and not their rulers.
That I believe that election is not a battle but only a process for electing peoples’ representatives and should be managed in a transparent manner.
That I believe that being elected as a representative of people is not an end but only means to serve the people and the country.
That I believe that India building is a team activity and not the sole prerogative of a few people or a party or parties.
That I have made all declarations as required under law while filing my nomination.
That I will abide by the code of conduct and any other guidelines made and issued by Election Commission.
That I attach great importance to my relationship with other Indians, and I have signed the ‘Manifesto of Relationship’.
That I will work for continual improvement in day-to-day life of all Indian people.
That I will always be pro-all and anti-none.
That I will manage country’s affairs in an effective, efficient and transparent manner.
That for me duties shall have precedence over rights.That I will be pro-active to peoples’ problems and their solutions.
That I believe that religion does not need politics but politics should be guided by religion.
That I believe that religion means truth, non-violence, love, compassion, brotherhood, service, non-discrimination, non-exploitation and respect for each other.
That I will behave in a disciplined manner in Lok Sabha and elsewhere, and will never create a situation where people electing me as their representative are embarrassed.
That I will discourage use of such terms which have given a wrong meaning and purpose to democratic institutions, like ‘fighting election’, ‘ruling India’, ‘our rule’.
That I will use only positive slogans.
That I stand committed to encourage positive vote and discourage negative vote.
I seek your vote only on my merits and not on the de-merits of other candidates.
